Covenant Revision Surveys
As you may be aware, there has been interest in revising the covenants in The Pinery for quite some time. Below is the first of a planned series of surveys for you to use to help The Pinery Homeowners’ Association get as broad a consensus as possible of ideas and opinions so we can proceed in this process.

The first question is of course key because we need to know how
many want us to even continue down the road of revision. The rest of this survey
deals with parking surfaces.

We are again asking if covenants should
be revised. Approximately 70% of the first survey respondents have answered yes
to this question. Therefore, we will continue with the process, but as we do so,
we want to continue to ensure that the position has not changed. The rest of
this survey deals with parking of recreational vehicles, trailers, etc. and with
exterior colors.

We are again asking if covenants should
be revised. Based on the positive response received, we will continue with the
process, but as we do so, we want to again ensure that the position has not
changed. The rest of this survey deals with exterior maintenance and the
number of garage doors.

This survey deals with two
critical issues: the voluntary nature of HOA financing and the use of
properties. When the Pinery was established in the early 70s, no allowance
was made in Covenants for funding of an organization which would be charged with
covenant enforcement and maintenance of common properties. Also, current
covenants prohibit use of Pinery properties in filings 1 - 8A for business of
any sort.

This survey deals with
exterior materials allowed in the Pinery. Some Pinery filings limit exterior
materials to “stone, stone veneer, brick or brick veneer, rough sawn or resawn
wood siding, or stucco”. Other filings continue the statement with “or other
building exterior construction materials approved by The Pinery Architectural
Review Committee”. The purpose of this question is to determine whether the
community desires consistency in this rule and if materials should be
specifically expanded. The survey also asks whether covenant enforcement
capability should include fines for violations of Protective Covenants.
Current covenants do not address imposition of fines. Finally, is there a topic

suggest?
