COVENANT REVISION SURVEY #5

   This survey deals with exterior materials allowed in the Pinery. Some Pinery filings limit exterior materials to “stone, stone veneer, brick or brick veneer, rough sawn or resawn wood siding, or stucco”. Other filings continue the statement with “or other building exterior construction materials approved by The Pinery Architectural Control Committee”. The purpose of this question is to determine whether the community desires consistency in this rule and if materials should be specifically expanded. The survey also asks whether covenant enforcement capability should include fines for violations of Protective Covenants. Current covenants do not address imposition of fines. Finally, is there a topic which has not yet been covered in a previous survey that you would like to suggest?

  All filings should include verbiage which allows additional materials to be approved by the Architectural Control Committee or Executive Board.
Any additional materials allowed should present a natural appearance in keeping with the tradition and ‘look’ of the Pinery.
Covenants should place no restriction on the type of exterior materials allowed in the Pinery.

The Pinery should impose fines for violations of Protective Covenants

If a violation is not corrected with a reasonable time after notification and opportunity to discuss with the Architectural Control Committee, fines which cover enforcement expense only should be imposed.

In addition to the above, if the violation continues on an ongoing basis, monthly fines should be imposed until compliance is achieved.
